South Africa’s Heritage Day and the Sunday-to-Monday rule

Heritage Day is 24 September every year. The leave is not always 24 September. Section 2(1) of the Public Holidays Act is why a Sunday Heritage Day becomes a Monday off, and why this site’s 2028 list says Heritage Day (observed) on 25 September.

Section 2(1) in the Act I actually opened

I opened the English text of the Public Holidays Act 36 of 1994 as published in Government Gazette No. 16136 of 7 December 1994 on the Parliament of South Africa site. Section 2 is headed “Days to be observed as public holidays.” Section 2(1) says the days mentioned in Schedule 1 shall be public holidays, “and whenever any public holiday falls on a Sunday, the following Monday shall be a public holiday.”

That sentence is the whole rule. It is not a Kenya-style “move the Sunday off the list.” Sunday remains the named day. Monday is also a public holiday. This site’s South Africa list therefore shows both dates when the Act adds that Monday.

Section 2(2) of the same Act says that notwithstanding subsection (1), any public holiday shall be exchangeable for any other day fixed by agreement between employer and employee. Bargaining councils and workplace deals can move a day this page will never list. The Department of Employment and Labour is the labour front door I am willing to name. Africa Calendar is not that department.

Heritage Day is 24 September on Schedule 1

Schedule 1 of Act 36 of 1994, the calendar I opened in that same PDF, lists Heritage Day on 24 September. It sits between National Women’s Day on 9 August and Day of Reconciliation on 16 December. The Schedule also names New Year’s Day, Human Rights Day, Good Friday, Family Day, Freedom Day, Workers’ Day, Youth Day, Christmas Day, and Day of Goodwill.

Family Day is “Monday after Easter Sunday,” not “Easter Monday.” Day of Goodwill is 26 December, not Boxing Day. I keep those Act names on South Africa 2026. Heritage Day does not get a second civil name on this site.

The Act I opened does not narrate a pre-1994 provincial name for 24 September. I will not add a “formerly Shaka Day” sentence I could not verify from that PDF or from another official page I successfully opened.

A Saturday Heritage Day is not a Monday

Section 2(1) is a Sunday rule. It is not a weekend rule. A Saturday public holiday does not, under the sentence I opened, mint a Monday. Human Rights Day on Saturday 21 March 2026 is the clean example on this site’s 2026 list: the Saturday coincides with the ordinary weekend and stops there.

Heritage Day is Thursday 24 September 2026 — a mid-week close. It is Friday 24 September 2027 — a natural three-day weekend without a substitute add-on. It is Sunday 24 September 2028, and Monday 25 September 2028 appears as the added public holiday.

If you copy “Heritage Monday” from 2028 into 2026, you will take Thursday off in your head and still come to work. Plan the year from the hub, not from a proverb about September.

Why 25 September 2028 is labelled Heritage Day (observed)

This site’s 2028 South Africa list shows Sunday 24 September as Heritage Day and Monday 25 September as a generic “Public Holiday” until I rename that Monday. That generic Monday is the Act’s following Monday. It is not a second commemoration with no name.

On 19 October 2026 I corrected that label on this site. I now rename that generic Monday to “Heritage Day (observed)” when it follows a Sunday Heritage Day. The South Africa 2028 hub and the leave planner use the named row. The 25 September 2028 label is locked so the generic name cannot silently return.

I would rather print an ugly “(observed)” than leave a payroll clerk staring at “Public Holiday” with no Sunday to attach it to. The Act added a Monday. The name belongs to Heritage Day.

How Heritage Day sits next to the rest of the spring

National Women’s Day is Sunday 9 August 2026, so Monday 10 August 2026 is the Act Monday, labelled National Women’s Day (observed) on this list. Heritage Day that year is a Thursday six weeks later. They are not one spring break.

In 2027, National Women’s Day is already a Monday (9 August) and Heritage Day is already a Friday. The Sunday rule does not need to work in August or September that year. December instead adds Monday 27 December 2027 after Sunday Day of Goodwill.

In 2028, Youth Day is Friday 16 June and Heritage Day is the Sunday-plus-Monday September pair. Those two dates do more leave work than Thursday Freedom Day (27 April 2028). The South Africa leave-planning guide is the year-by-year map; this page is the statute behind one row.

Paid holidays, and the rate I will not quote

Section 5 of the Act I opened says every employee shall be entitled to at least the number of public holidays in the Act, and to payment for every public holiday at least as favourable as the then Basic Conditions of Employment Act provision it points at. I am not your bargaining council. I will not convert that 1994 cross-reference into a 2026 rand figure.

Section 5(2) preserves workplace deals that already give more public holidays than Schedule 1. A mine or a municipality can close when this national list stays open. Ask the council.

The payroll guide stays at rest days versus observed weekdays. Heritage Day (observed) on a Monday is an observed weekday. Sunday 24 September 2028 is the named day on a rest day. Do not pay them as if they were the same timesheet line unless your counsel says so.

How I would plan a Heritage week

In 2026, decide whether Thursday 24 September is a single-day close or whether you will spend Friday 25 September as annual leave. The Act does not spend that Friday for you. In 2027, take the Friday as the free long weekend. In 2028, count Monday 25 September and do not count Sunday as a lost weekday.

Print from the studio after picking South Africa and the year. Subscribe at /feeds/za-2026.ics, /feeds/za-2027.ics, or /feeds/za-2028.ics. The 2028 feed should carry the observed Monday once that named label is on the list you subscribed to.

If the Act or a presidential proclamation disagrees with a row, email contact@africacalendar.app. I will correct the holiday list. I will not argue with section 2(1).
